Terms of Service
Effective 11 October 2026
These terms are an agreement between you and Lushy ("Lushy", "we", "us"), which runs the Lushy app and lushyapp.com. By creating an account you agree to them. If you don't agree, don't use Lushy.
1. What Lushy is, and what it is not
- Lushy is a platform where independent beauty professionals ("pros") show their work and clients find and book them.
- Lushy is not a beauty business. We do not employ pros, provide or supervise their services, or set their prices. Each pro runs their own independent business and is responsible for their work, prices, hygiene, any licences they need, and how they behave.
- When you book a pro, the agreement for that service is between you and the pro. Lushy is not a party to it.
- We do not check pros' identity, qualifications or the quality of their work. Photos, prices and descriptions on Lushy come from the pros themselves. Use your own judgement before booking.
2. Who can use Lushy
- You must be 18 or over. We ask for your date of birth when you sign up and do not allow accounts for anyone younger.
- If we learn that someone under 18 has an account, we close it and delete their information.
- One person, one account. You may not use Lushy if we have removed you before.
- If you offer services as a pro, you must be allowed to do that work in Botswana.
3. Your account
- Give accurate information — your real name, phone number and date of birth — and keep it up to date.
- Keep your password private. You are responsible for what happens on your account. If you think someone else has got in, tell us at support@lushyapp.com.
- Your date of birth cannot be changed once saved. If it is wrong, contact support.
- A client account can add a business and become a pro, and close that business later (section 8). The account stays the same.
- You can delete your account at any time in Settings → Security & Privacy → Delete My Account. What that removes is set out in the Privacy Policy.
4. Bookings and cancellations
- A booking you send is a request. It becomes an appointment only when the pro accepts it in the app. Requests the pro does not answer in time expire.
- The price recorded on a booking is the price shown when you sent it: the service price plus any house-call extra the pro has set. It cannot be changed in the app afterwards.
- A post may say whether the price includes hair or products ("fix & supply") or not ("fix only"). If it doesn't say, ask the pro before you book.
- Either of you can cancel a pending or accepted booking in the app. Repeated no-shows or last-minute cancellations, by either side, can lead to suspension.
5. Payment
- Lushy does not take payment for services. You pay the pro directly — cash, transfer or card, as you agree with them.
- Lushy does not hold, refund or guarantee any money between clients and pros.
- Deposits, late-cancellation fees and no-show fees are a matter between you and the pro. A pro who charges them must tell you before you book. Lushy charges none of them.
- A disagreement about payment or the quality of a service is between the client and the pro. We will look at reports, but we are not obliged to settle the dispute.
6. House calls and your safety
- Some pros visit clients at home, and some clients visit pros who work from home. Lushy does not vet either side and is not present at appointments.
- Before an appointment, talk to the other person in Lushy's chat, tell someone you trust where you are going and when, and keep your conversations in the app.
- If you feel unsafe, leave or ask the other person to leave. Report and block them from the "…" menu.
- In an emergency, contact the police on 999.
7. If you offer services as a pro
- Post only photos of work you did yourself and have the right to share. If a client can be recognised in a photo, get their permission first.
- Keep prices and descriptions accurate, and honour an accepted booking at the price recorded on it.
- You are responsible for your own taxes, licences, hygiene and products, and for any harm your work causes.
- Clients whose bookings you accept can see your phone number so they can reach you.
- You keep ownership of your photos. You give Lushy a free, non-exclusive licence to show them in the app and on lushyapp.com, and to feature your work with your business name in Lushy's own marketing, such as social media posts. You can ask us at any time to stop using your work in marketing. The licence ends when you delete the post or your account, except for marketing already published before then.
8. Closing your business
- A pro can close their business at any time in Settings → Close My Business.
- Closing removes your posts from the feed, stops new bookings and new chats, and cancels your upcoming appointments. Those clients see that the business closed.
- A closed business is never billed.
- You can reopen at any time. The same business returns with its posts and reviews. Reopening does not restart any free period.
9. Subscriptions for pros
- Lushy is free for pros during the launch period.
- Before any charge starts, we will tell you the price and how to pay at least 30 days in advance. Nothing is charged unless you choose to pay, and we never charge automatically unless you turn on automatic payment yourself.
- Only open businesses are billed. Client accounts are never billed.
10. Reviews
- After a completed booking, the client can rate it. Reviews must be honest and about your own experience.
- No fake reviews, no reviewing yourself, and no offering anything in exchange for a review.
- We may remove reviews that break these terms. We do not edit them.
11. Sponsored business cards
- Lushy shows a row of cards from local businesses, marked "Ad". They are paid placements.
- We review each business before its card goes up, but we do not endorse or guarantee its products or services. Anything you arrange with a sponsored business is between you and them.
- You can report a sponsored card from its "…" menu.
12. What you may not do
- Break the law, or use Lushy to arrange anything illegal.
- Harass, threaten, bully or abuse anyone, or post hateful content.
- Post or send sexual content, nudity or violence.
- Scam people: fake listings, fake prices, asking for money for services you won't provide, or pretending to be someone else.
- Post someone else's work as your own.
- Send spam, or collect other users' information for any purpose outside a booking.
- Try to break, overload, copy or get around the security of the app or the website.
13. Reporting, blocking and moderation
- There is zero tolerance for objectionable content or abusive behaviour on Lushy.
- Every post, profile and sponsored card can be reported from its "…" menu, and any message by pressing and holding it. We review every report within 24 hours and remove content that breaks these terms.
- You can block anyone from the same menu. It hides them from you, stops either of you messaging the other, and cancels any bookings between you.
- Reports are confidential. We never tell the reported person who reported them.
14. Suspending or removing accounts
- We may remove content, or suspend or close an account, that breaks these terms or puts other people at risk.
- We will tell you why, unless the law or someone's safety prevents it. To appeal, write to support@lushyapp.com.
15. Limits on Lushy's responsibility
- Lushy is provided as it is. We work to keep it running, but we do not promise it will always be available or free of errors.
- As far as Botswana law allows, Lushy is not responsible for:
- services pros provide, or anything that happens at an appointment, including injury, allergic reactions, damage or loss;
- disputes between clients and pros, including about payment;
- what users post or send;
- the products or services of sponsored businesses;
- indirect losses, such as lost income or opportunities.
- Where Lushy is responsible, the most it will pay is the greater of what you paid Lushy in the 12 months before the claim and P500.
- Nothing in these terms takes away rights you have that the law does not allow to be taken away, including under Botswana's Consumer Protection Act.
16. Claims caused by you
If someone makes a claim against Lushy because you broke these terms, or because of a service you provided as a pro, you agree to cover Lushy's reasonable costs of dealing with it.
17. Disputes and the law that applies
- These terms are governed by the laws of Botswana.
- If you have a problem with Lushy, write to support@lushyapp.com first and give us 30 days to put it right.
- If that doesn't resolve it, the courts of Botswana decide.
18. Changes to these terms
We will tell you in the app at least 14 days before an important change takes effect. If you keep using Lushy after that date, the new terms apply. If you don't agree, you can delete your account.
